AFFF Firefighter foam lawsuit

What is AFFF Firefighter Foam?

AFFF stands for Aqueous Film Forming Foam, which is a fire deterrent used to smother flammable liquid fires such as fuel fires. The PFAS are components in the foam to help foam to spread and cool to smother the fire. PFAS is extremely helpful but the chemicals cause several types of injury due to it being toxic.

Types of Injuries Caused by Fire Fighter Foam

The injuries that are caused by this foam are usually different forms of cancer, such as:

  • bladder cancer
  • breast cancer
  • leukemia
  • liver cancer
  • colorectal cancer (colon and/or rectal cancer)
  • lymphoma
  • ovarian cancer
  • pancreatic cancer
  • prostate cancer
  • renal or kidney cancer
  • testicular cancer
  • thyroid cancer and disease
  • ulcerative colitis
  • uterine or endometrial cancer
  • thyroid cancer and disease.

These illnesses come from PFAS in firefighting foams.

Who is Most at Risk of Exposure to Firefighter Foam?

The risk of utilizing AFFF is often taken by firefighters, voluntary firefighters, airport personal, and military personnel. The use of AFFF that contains PFAS has a toxic component that when used can contaminate grounds and water where there is military and fight fighter training, this means that civilians in the area could also be exposed. Those that are exposed and suffer from the effects of AFFF exposed might have the right to file suit.

Who can file a AFFF Lawsuit? How do I know if I have a Case?

Those who would be able to file suit are those that can prove that they have been exposed to AFFF and that the foam had PFAS in the chemical mixture. Then that person must link that the exposure resulted in them receiving bladder cancer, breast cancer, leukemia, liver cancer, colorectal cancer (colon and/or rectal cancer), lymphoma, ovarian cancer, pancreatic cancer, prostate cancer, renal or kidney cancer, testicular cancer, thyroid cancer and disease, ulcerative colitis, uterine or endometrial cancer, and thyroid cancer and disease from firefighting foam.

Do you believe you might have a firefighting foam lawsuit?

The best way to confirm this is to go to a doctor and express to a medical professional when you would have been exposed to AFFF and that you believe the exposure could have caused you to be diagnosed with cancer or disease.

What does an AFFF lawsuit look like?
A firefighting foam lawsuit will start with the attorney receiving information about evidence of exposure and the work environment in that a person would have been exposed to cancer from PFAS in firefighting foam. Then the person’s medical history of cancer received from exposure along with laboratory testing reports and medical bills will be collected to find the amount of loss from the result of exposure. The information collected up until this point will be used to file suit. The attorney will then make efforts to settle the claim with the manufacturer involved. This is not likely, as manufacturers have not settled or made efforts to settle.

Firefighting Foam Lawsuits Are Being Filed

In many cases, the manufacturers of AFFF were aware of how toxic the foam component could be and continued to produce and sell AFFF for use. The manufacturers involved in this suit are using the defense of a government contractor. This means 1) the United States approved reasonably precise specifications of AFFF; (2) that AFFF conformed to those specifications; and (3) the manufacturers warned the United States about the dangers in the use of AFFF that were known to the supplier but not to the United States.

Who were the largest manufacturers of AFFF or Firefighting Foam?

The most popular and largest manufacturers of AFFF are:

  • 3M Company
  • AGC Chemicals Americas Inc
  • Amerex Corporation
  • Angus Fire Armour Corporation
  • Archroma Management
  • Arkema
  • Asahi
  • BASF Corporation Tyco Fire Products
  • Chemguard
  • Carrier Global Corporation
  • Clariant, Corteva
  • Dynax Corporation
  • Kidde Fire Fighting
  • Buckeye Fire Equipment
  • Dupont
  • Chubb Fire
  • The Chemours Company.

These manufacturers are not attempting to settle these cases but the legal field has estimated expectations of what settlement may look like for those affected.

What are the Settlements For AFFF Lawsuits?

While it is not sure looking at how cases of many people being injured by a dangerous product have been resolved, an AFFF lawsuit settlement should exceed $150,000. If taken to trial, which is more unlikely due to cost, the average jury verdict could exceed $1,000,000. These amounts come from consideration given to

  • past and present medical expenses
  • projected future expenses
  • out-of-pocket expenses
  • lost wages
  • loss of earning capacity in the future
  • pain and suffering
  • emotional distress
  • loss of consortium
  • funeral expenses in case of death of a victim exposed to cancer from firefighting foam
  • expenses for care
  • and punitive damages for the manufacturer knowledge of the risk associated with AFFF.
