You want to call the police or state troopers. Call 911, get them out there, get the vehicle inspected. You would get his insurance information and you would contact the insurance company immediately and you’d send a letter out. You also want to talk to the driver and see what he looks like — maybe smell his breath, make sure he wasn’t drinking, look at his eyes, make sure they’re not glassy.
You’re going to want to get an expert to download the black box. It will tell you a lot of information about when he applied the breaks, how long it took him. There could be maintenance issues, his breaks may not be working. There are just a lot of different issues that come with truck accidents. You want to send him a spoliation letter telling him to hang onto his log books because if you don’t do it, the evidence will disappear.
