What is a Tort?

Negligent torts are much different from cases that involve intentional torts. Today we are going to take a look at what exactly is a tort?

First of all, what is a tort? A tort is a civil wrong. Although the defendant can be found criminally liable if the case constitutes that.   Example: a punch in the nose can be found criminally liable, and also for damages in civil court.  Criminal liable is used to protect the society, in civil court it allows the victim to receive justice in monetary.  Punching someone in the face would be considered an intentional tort.

Negligence has to do with a reasonable and prudent person- Unintentional, but the interest to protect the person is still there.  Everyone owes everyone a reasonable care not to injure someone.

Strict liability is a tad different. Strict liability occurs if one chooses to engage in activity that is inherently dangerous one is responsible for all actions that occur from this dangerous act.  There does not have to be intent of the act to happen.  Example: keeping a wild animal and the animal attacks someone, you are held to strict liability.
